About Company

The Competition Authority of Kenya (CAK) is an independent statutory agency established under the Competition Act No. 12 of 2010. Its primary mandate is to promote and safeguard fair competition in Kenya’s economy and protect consumers from unfair and misleading market conduct. The Authority began its operations on August 1, 2011, and is headquartered in Nairobi.

Core Functions

CAK’s responsibilities include:

  • Enforcing Competition Law: Investigating and prosecuting anti-competitive practices such as cartels, abuse of dominant positions, and unfair trade practices.

  • Merger Control: Reviewing mergers and acquisitions to ensure they do not substantially lessen competition in the market.

  • Consumer Protection: Safeguarding consumers by addressing anti-competitive practices that harm consumer welfare and educating consumers on their rights.

  • Advocacy and Public Education: Engaging in public education and advocacy on competition-related issues and providing guidance to businesses on compliance with competition laws.

  • Market Research: Conducting market research to understand the competition landscape and inform enforcement activities and policy development.

  • International Cooperation: Collaborating with other competition authorities and organizations to promote competition policy and law in Kenya and the East African region.

Leadership

As of October 7, 2024, David Kibet Kemei serves as the Director-General of the Competition Authority of Kenya. He brings over 30 years of experience in regulatory, financial, corporate governance, and commercial sectors. Mr. Kemei took over from Dr. Adano Wario, who served as the Acting Director-General since January 2023.
